Although being in a car accident can be scary and overwhelming, knowing what to do in the moments following a vehicle wreck can help alleviate some of the usual anxiety and confusion. TheAbelson Law Firm offers the following tips on how to deal with car accidents:
- Safety first. If your accident is minor with no serous injuries, move your car to the side of the road, out of the way of oncoming traffic. Leaving cars parked in the middle of the road can result in additional accidents and injuries. If your car cannot be moved, remain in the car with your seatbelt fastened until help arrives. Be sure to turn on your hazard lights and set out any cones, flares or warning triangles you have in your possession.
- Exchange information. Be sure to get the name, address, phone number, insurance company, policy number, driver license number and license plate number for the driver and the owner of each vehicle. Also make a written description of each car, including year, make, model and color — and the exact location of the collision and how it happened.
- Gather details. If possible, photograph and document the accident. Although the police report should capture the details of the accident, it is always helpful to take photos for your own documentation.
- Talk to witnesses, and obtain their contact information. They may be able to help you if the other drivers dispute your version of what happened.
- Don’t volunteer information. Do not make any comments at the scene or about the accident, such as how the accident happened, or whose fault you think it was. Any comments you make can be used against you when your lawyer seeks to settle the case, or at the trial of your personal injury case.
- File an accident report. You should file a state vehicle accident
report, available at police stations or online on the Department of
Motor Vehicles website.
Notify your insurance company. Report the accident to your insurance company, even if you think the other driver is at fault. In order to protect your right to insurance coverage, your insurance company is entitled to be notified by you about the accident, any injuries to you or other passengers, as well as damage to the car. - Contact a lawyer.
